1. Purpose

These terms and conditions of use and sale (the "Terms") govern access to and use of the website salarypitch.com, published by Jérôme MICHEL, sole trader (the "Publisher"), by any natural person acting for non-professional purposes (the "User"). Any use of the service constitutes acceptance of these Terms.

2. Description of the service

SalaryPitch is an online service that helps you prepare for salary negotiation. In particular, by voice, it lets you build a profile, generate a number-backed pitch, practice against an HR counterpart simulated by artificial intelligence, and track your progress. The service is provided "as is" and evolves over time.

SalaryPitch is a preparation tool. It provides neither legal advice nor personalized employment advice, and guarantees no negotiation outcome.

3. Account and access

Access to the service requires creating an account with an email address. Authentication is done via a sign-in link sent by email (no password). The User is responsible for the confidentiality of their inbox and for activities carried out from their account. The User undertakes to provide accurate information.

4. Paid trial

Access to premium features (mock interviews, voice wins) begins with a 7-day trial priced at €4.99, payable on sign-up. During the trial, access is limited to 2 mock interviews and 5 voice wins in total. At the end of the 7 days, the annual subscription automatically takes over at the prevailing rate, unless cancelled before the end of the trial. Account creation and pitch generation remain available for free.

5. Subscription and price

After the trial, the premium service is offered as an annual subscription of €99 for 12 months, preceded by the 7-day trial at €4.99.

As part of fair use of the voice features, the annual subscription includes 3 mock interviews and 10 voice wins per month of subscription, each interview being limited to approximately 10 minutes. Unused monthly volumes roll over and accumulate throughout the current subscription period; they reset at each annual renewal. Pitch generation and journal access remain unlimited.

Prices are shown in euros. VAT not applicable, Article 293 B of the French General Tax Code (VAT exemption). The Publisher may change its prices; any change has no effect on the period already paid for.

6. Payment

Payments are processed by our provider Stripe. The Publisher never has access to full bank card details. The subscription renews automatically on an annual basis until cancellation. In the event of a payment failure, premium access may be suspended.

7. Term and cancellation

The subscription is taken out for a 12-month term and renews automatically. The User may cancel at any time from their account area; cancellation takes effect at the end of the current period, with no refund for the period already started. The simplified cancellation conditions provided for by the French Consumer Code apply.

8. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer User in principle has a 14-day withdrawal period. However, as this is digital content supplied immediately and a service fully performed before the end of that period, the User expressly requests immediate performance of the service upon subscription and acknowledges waiving their right of withdrawal once the service has been fully performed, in accordance with Article L221-28 of the same code.

9. User obligations

  • Use the service in accordance with these Terms and with the law;
  • Not attempt to disrupt, circumvent or misuse the service;
  • Not share unlawful or defamatory content, or content that infringes the rights of third parties.

10. Liability

The Publisher implements reasonable means to ensure the availability and reliability of the service, with no guarantee that it will be free of interruption or error. As SalaryPitch is a preparation tool, the Publisher cannot be held liable for the outcome of a negotiation, an employer's decision, or the use made of the generated content. The Publisher's liability may not exceed the amounts actually paid by the User over the last twelve months.

11. Suspension and termination by the Publisher

In the event of a serious breach of these Terms, the Publisher may suspend or terminate access to the account, after informing the User where possible.

12. Personal data

The processing of personal data is described in our privacy policy, which forms an integral part of these Terms.

13. Intellectual property

The intellectual property terms are set out in the legal notice.

14. Changes to the Terms

The Publisher may amend these Terms. The applicable version is the one in force at the time the service is used. Substantial changes are brought to the User's attention.

15. Consumer mediation

In accordance with the French Consumer Code, the consumer User may use a consumer mediator free of charge to seek an amicable resolution of a dispute, after having tried to resolve it directly with the Publisher. The User may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

16. Governing law and disputes

These Terms are governed by French law. Failing an amicable resolution, any dispute falls under the competent courts in accordance with the French Consumer Code.
