1. Purpose
These terms and conditions of use and sale (the "Terms") govern access to and use of the website salarypitch.com, published by Jérôme MICHEL, sole trader (the "Publisher"), by any natural person acting for non-professional purposes (the "User"). Any use of the service constitutes acceptance of these Terms.
2. Description of the service
SalaryPitch is an online service that helps you prepare for salary negotiation. In particular, by voice, it lets you build a profile, generate a number-backed pitch, practice against an HR counterpart simulated by artificial intelligence, and track your progress. The service is provided "as is" and evolves over time.
SalaryPitch is a preparation tool. It provides neither legal advice nor personalized employment advice, and guarantees no negotiation outcome.
3. Account and access
Access to the service requires creating an account with an email address. Authentication is done via a sign-in link sent by email (no password). The User is responsible for the confidentiality of their inbox and for activities carried out from their account. The User undertakes to provide accurate information.
4. Free access
Account creation, pitch generation and journal access are available for free, with no time limit. Every new User also receives a first complimentary voice win and a first complimentary mock interview, the latter limited to approximately 5 minutes and giving access to a preview of their debrief. Full access to the voice features requires the pack described in section 5.
5. Pack and price
The premium service is offered as a one-time payment pack of €29.99. This is not a subscription: no further amount is charged and the pack does not renew.
The pack grants 20 voice wins of 3 minutes and 5 mock interviews of 10 minutes, i.e. a total of 110 minutes of voice conversation, usable for 35 days from payment. One credit is deducted when each voice session opens. The win and the mock interview offered before purchase are deducted from the first pack; they are not added to it. Pitch generation and journal access remain free and unlimited, both during and after the pack's validity.
The stated durations are maximum durations per session: a shorter session uses a full credit and gives no right to carry over the unused time.
Prices are shown inclusive of all taxes, in the currency displayed at the time of purchase; the amount charged is the one shown before payment is confirmed. VAT not applicable, Article 293 B of the French General Tax Code (VAT exemption). The Publisher may change its prices and the contents of its packs; any change has no effect on a pack already purchased, which remains governed by the terms in force on the day of payment.
6. Payment
Payments are processed by our provider Stripe. The Publisher never has access to full bank card details. The payment is a one-off and there is no automatic renewal: no payment method is retained for a future charge, and the User can only be charged again by deliberately purchasing a new pack. A receipt is sent to them by email once payment is complete.
7. Validity period
The pack is valid for 35 days from the date payment is received. On expiry, unused credits are lost and give no right to any refund, carry-over or extension. There is no cancellation or pause to carry out: the pack ends by itself.
The User may purchase a new pack at any time. A new pack opens its own credits and its own validity period; it does not extend the previous one, and credits from two packs do not accumulate. After expiry, the account, the pitch and the journal remain accessible for free.
8. Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer User in principle has a fourteen-day withdrawal period.
The pack is, however, the supply of digital content not supplied on a tangible medium, whose performance begins immediately after payment. By ticking the box provided for that purpose at the time of payment, the User gives their prior express consent to immediate performance of the service before the withdrawal period expires, and expressly waives their right of withdrawal, acknowledging that they have been informed of this.
This waiver is provided for by Article L221-28 of the French Consumer Code. Consequently, performance having begun, no refund is made. Ticking this box is mandatory: without it, payment cannot go through. The consent so obtained is retained for every purchase.
9. User obligations
- Use the service in accordance with these Terms and with the law;
- Not attempt to disrupt, circumvent or misuse the service;
- Not share unlawful or defamatory content, or content that infringes the rights of third parties.
10. Liability
The Publisher implements reasonable means to ensure the availability and reliability of the service, with no guarantee that it will be free of interruption or error. As SalaryPitch is a preparation tool, the Publisher cannot be held liable for the outcome of a negotiation, an employer's decision, or the use made of the generated content. The Publisher's liability may not exceed the amounts actually paid by the User over the last twelve months.
11. Suspension and termination by the Publisher
In the event of a serious breach of these Terms, the Publisher may suspend or terminate access to the account, after informing the User where possible.
12. Personal data
The processing of personal data is described in our privacy policy, which forms an integral part of these Terms.
13. Intellectual property
The intellectual property terms are set out in the legal notice.
14. Changes to the Terms
The Publisher may amend these Terms. The applicable version is the one in force at the time the service is used. Substantial changes are brought to the User's attention.
15. Consumer mediation
In accordance with the French Consumer Code, the consumer User may use a consumer mediator free of charge to seek an amicable resolution of a dispute, after having tried to resolve it directly with the Publisher. The User may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
16. Governing law and disputes
These Terms are governed by French law. Failing an amicable resolution, any dispute falls under the competent courts in accordance with the French Consumer Code.
